When you submit a message for analysis, you grant ScamSafe a limited, non-exclusive licence to process that content for the sole purpose of generating your verdict. You confirm that you are entitled to submit the content, that you understand it is transmitted securely to Anthropic's Claude API and is not retained after analysis, and that you will not deliberately submit content containing sensitive personal data such design, layout, logos, Scam Tips content, and Scam of the Month articles — is the property of ScamSafe or its licensors and is protected by Irish and EU intellectual property law.

You may access content for personal use and share links to scamsafe.ie. You may not copy, reproduce, or republish substantial portions of ScamSafe content without prior written permission, or use ScamSafe's name or branding in any way that implies endorsement without express written consent.

9.1 Service Provided "As Is"

ScamSafe is provided free of charge on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of any verdict or content generated by the service.

9.2 No Liability for AI Verdicts

To the fullest extent permitted by applicable Irish and EU law, ScamSafe and its operators accept no liability for any loss, damage, or harm arising from reliance on an AI-generated verdict; any failure to detect a scam message or any false positive verdict; or any financial loss, theft, fraud, or other harm suffered as a result of a scam, whether or not the relevant message was checked on ScamSafe.

9.3 No Liability for Service Availability

We do not guarantee that the service will be available at all times. ScamSafe may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

9.4 Consumer Rights

Nothing in these terms limits or excludes any rights you have under Irish consumer protection law or EU consumer law that cannot be excluded or limited by contract.

10. Indemnity

By using ScamSafe, you agree to indemnify and hold harmless ScamSafe and its operators from any claims, losses, damages, or expenses arising from your breach of these Terms of Service, your misuse of the tool, or any content you submit that infringes the rights of a third party.

11. Privacy and Data Protection

Your use of ScamSafe is also governed by our Privacy Policy, available at scamsafe.ie/privacy. ScamSafe is registered as a Data Controller with the Data Protection Commission (DPC) of Ireland. 12. Service Availability, Suspension, and Discontinuation

12.1 Force Majeure

ScamSafe shall not be liable for any failure or delay in providing the service where that failure or delay results from circumstances beyond our reasonable control, including failure of third-party services, internet outages, acts of God, acts of government, cyberattacks, or industrial action.

12.2 Suspension of Individual Access

We reserve the right to suspend or restrict your access to ScamSafe — immediately and without prior notice — if we reasonably believe that you are in breach of these Terms of Service, using the service abusively or fraudulently, or submitting automated or bulk queries without permission.

12.3 End of Life and Discontinuation

ScamSafe is a free service and we do not guarantee its continued availability. We reserve the right to discontinue the service at any time. In the event of a planned discontinuation, we will endeavour to provide at least 30 days' notice via a notice posted on scamsafe.ie.

13. Changes to the Service and These Terms

We reserve the right to modify ScamSafe or any part of it at any time, with or without notice. We may update these Terms of Service from time to time. When we make material changes, we will update the 'Last updated' date at the top of this page. Your continued use of ScamSafe after changes are posted constitutes your acceptance of the updated terms.

14. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Ireland. Any disputes arising out of or in connection with these terms or your use of ScamSafe shall be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to any rights you may have under EU consumer protection law to bring proceedings in your country of residence.
